1. Agreement to Terms
By accessing or using Dicey.CC (the "Service"), operated by Ping Enterprises LLC (DBA Apokalyptic Publishing) ("we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you must not access or use the Service.
These Terms constitute a legally binding agreement between you ("User" or "you") and Ping Enterprises LLC (DBA Apokalyptic Publishing). We reserve the right to update these Terms at any time. Continued use of the Service following notice of changes constitutes your acceptance of the revised Terms.
2. Description of Service
Dicey.CC is a web-based software-as-a-service (SaaS) platform that provides tabletop roleplaying game (TTRPG) character creation, management, and organizational tools. The Service is intended for personal, non-commercial use by TTRPG players and game masters unless otherwise authorized under a commercial license.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent. By using the Service, you represent and warrant that you meet these eligibility requirements.
4. Accounts and Registration
4.1 Account Creation. Certain features of the Service require registration. You agree to provide accurate, current, and complete information and to keep your account information up to date.
4.2 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
4.3 Account Termination. We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.
4.4 Account Sharing Prohibited. Your account is registered to you personally and may not be shared with any other individual. You must not disclose your login credentials — including your username, password, or any authentication tokens — to any third party, nor may you allow any other person to access the Service using your account. Each individual user must maintain their own separate account. We reserve the right to suspend or terminate any account we reasonably determine is being accessed by multiple individuals, regardless of whether the sharing was intentional. Ping Enterprises LLC (DBA Apokalyptic Publishing) shall not be liable for any harm or loss resulting from your failure to maintain the confidentiality of your credentials or from unauthorized use of your account by a third party to whom you have disclosed your login information.
5. Intellectual Property — Third-Party Game Content
This section governs your use of third-party TTRPG intellectual property within the Service. It is among the most important provisions of these Terms.
5.1 No Affiliation or Endorsement. Dicey.CC is an independent tool. We are not endorsed by or in partnership with the publishers or rights holders of any TTRPG system unless explicitly stated in a separate, current licensing disclosure. Any use of game system names, mechanics, or terminology is done pursuant to applicable open or limited licenses, or constitutes nominative fair use solely for the purpose of identifying compatibility.
5.2 Supported Game Systems and Licensing. Where the Service supports content derived from specific game systems, such support is provided only to the extent permitted by the applicable publisher license (e.g., an open game license, fan content policy, or commercial partnership agreement). Users are responsible for independently verifying whether their intended use of any game content complies with the relevant publisher's licensing terms.
5.3 Prohibited Content — Copyrighted Reproductions. You must not use the Service to reproduce, distribute, transmit, publish, display, or create derivative works from any copyrighted TTRPG material without express written authorization from the rights holder. Prohibited conduct includes, but is not limited to:
- Entering, uploading, or storing verbatim or substantially reproduced text from rulebooks, sourcebooks, adventure modules, or supplements protected by copyright;
- Reproducing stat blocks, spell descriptions, monster entries, equipment tables, or other game content in a manner that would substitute for, or diminish the market for, the original published work;
- Creating character templates, compendium entries, or shared content that replicates paid or proprietary content for distribution to other users;
- Circumventing any content restrictions the Service may impose to limit reproduction of licensed material.
5.4 Prohibited Content — Trademark Infringement. You must not use any trademark, service mark, trade name, or logo owned by a third-party TTRPG publisher in a manner that is likely to cause confusion as to the source, sponsorship, or affiliation of your content, or in any manner not expressly permitted by the trademark owner's fan content or community use policies.
5.5 Prohibited Conduct — Piracy and Unauthorized Distribution. You must not use the Service as a vehicle for software piracy or unauthorized distribution of copyrighted works. Prohibited conduct includes:
- Sharing, linking to, or facilitating access to unauthorized copies ("pirated" copies) of rulebooks, PDFs, or other game materials;
- Using the Service to aggregate or redistribute content in a manner that constitutes an unauthorized compilation or derivative database of copyrighted game material;
- Importing data from sources that the User knows or has reasonable cause to believe constitute infringing copies of a protected work;
- Facilitating, encouraging, or assisting other users in any of the foregoing.
5.6 User Responsibility. You are solely responsible for ensuring that all content you create, input, upload, or share through the Service complies with applicable copyright, trademark, and other intellectual property laws, as well as any applicable publisher policies. We do not review user-generated content.
5.7 Our Intellectual Property Rights. All software, interface designs, original artwork, branding, documentation, and proprietary content comprising the Service are owned by Ping Enterprises LLC (DBA Apokalyptic Publishing) or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any portion of the Service without our prior written consent.
6. User-Generated Content
6.1 License Grant. By submitting, posting, or sharing any content through the Service ("User Content"), you grant Ping Enterprises LLC (DBA Apokalyptic Publishing) a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, reproduce, and display such User Content solely as necessary to operate and improve the Service.
6.2 Your Representations. You represent and warrant that: (a) you own or have the necessary rights to the User Content you submit; (b) your User Content does not infringe any third-party intellectual property right; and (c) your User Content does not violate any applicable law or these Terms.
6.3 Content Removal. We reserve the right, but not the obligation, to review, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
7. DMCA and Copyright Takedown Procedure
We respect the intellectual property rights of others and respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA").
7.1 Reporting Infringement. If you believe that content available through the Service infringes your copyright, please submit a written notice to our designated agent containing:
- A physical or electronic signature of the copyright owner or authorized agent;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material claimed to be infringing and sufficient information for us to locate it;
- Your contact information (address, phone number, and email);
- A statement that you have a good faith belief that the disputed use is not authorized;
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

7.2 Counter-Notifications. If you believe your content was removed in error, you may submit a counter-notification in accordance with 17 U.S.C. § 512(g).
7.3 Repeat Infringers. We will terminate the accounts of users who are determined to be repeat infringers.
8. Subscription Plans and Payment
8.1 Free Tier. The Service may offer a free tier subject to usage limitations described on our pricing page. Free tier availability is not guaranteed and may be modified or discontinued.
8.2 Paid Plans. Paid subscription plans are billed on a recurring basis as described at the time of purchase. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.
8.3 Changes to Pricing. We reserve the right to change subscription fees upon reasonable notice. Continued use of a paid plan following a price change constitutes your acceptance of the new pricing.
9. Prohibited Conduct Generally
In addition to the IP-specific prohibitions above, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation;
- Attempt to gain unauthorized access to the Service, its servers, or related systems;
- Transmit any malware, spyware, or other harmful code;
- Scrape, crawl, or extract data from the Service by automated means without our prior written consent;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Harass, threaten, or harm other users of the Service;
- Attempt to reverse-engineer, decompile, or disassemble any portion of the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PING ENTERPRISES LLC (DBA APOKALYPTIC PUBLISHING) AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless Ping Enterprises LLC (DBA Apokalyptic Publishing) and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property or privacy right.
13. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for claims involving intellectual property infringement.
14. Severability and Waiver
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms applicable to specific features of the Service, constitute the entire agreement between you and Ping Enterprises LLC (DBA Apokalyptic Publishing) regarding your use of the Service and supersede all prior agreements and understandings.
